This Acceptable Use Policy ("AUP") governs your use of the Cash Flow Optimizer platform provided by RealtoResource, LLC, doing business as Solidify Solutions. It forms part of, and is incorporated by reference into, our Terms of Service. By accessing or using the Services, you and each of your users agree to this AUP. You are responsible for any violation of this AUP by you or your users.
1. Reporting Suspected Violations
If you become aware of, or suspect, a violation of this AUP — including abusive email or messages sent through the Services — please report it to us at support@cfoptimizer.com. We investigate reports and respond in the manner we consider appropriate.
2. General Lawful-Use Requirement
You will use the Services only for your lawful, internal business purposes and in compliance with all applicable laws and regulations. You will not use the Services to engage in, promote, encourage, facilitate, or instruct others to engage in any illegal, fraudulent, deceptive, or harmful activity.
3. Financial, Billing, and Collections Use
Because Cash Flow Optimizer includes financial reporting, accounts-receivable, billing, and collections tools, you specifically agree that you will not use the Services to:
- create, send, or manage false, fraudulent, deceptive, or misleading invoices, bills, statements, or financial reports, or to misrepresent your financial condition to lenders, investors, tax authorities, auditors, or any other party;
- conduct unlawful, harassing, abusive, or deceptive debt-collection activity, or otherwise use the accounts-receivable or collections features in violation of the Fair Debt Collection Practices Act (FDCPA), state debt-collection laws, or any other applicable law;
- engage in money laundering, tax evasion, securities or accounting fraud, or the financing of illegal activity; or
- process, facilitate, or record transactions that you know or should know are fraudulent or unauthorized.
You are solely responsible for the accuracy and legality of the financial data you enter and the communications, invoices, and collection efforts you conduct through the Services.
4. Connected Financial and Third-Party Accounts
When you connect QuickBooks (via Intuit), bank or credit-card accounts (via Plaid), email, social-media, or other third-party accounts to the Services — including to sync communications (via Unipile) or to publish social content (via postforme.dev) — you represent and warrant that you own, or are duly authorized to access and manage, each connected account and the data in it, and that you have the authority and a lawful basis to sync, import, or publish the data involved, including any communications and third-party personal data. You will not connect or attempt to access any account, financial institution, or data that you are not authorized to access, and you will comply with the terms and policies of each connected provider.
5. Email, Anti-Spam, and Marketing
If you use the Services to send or manage email or other marketing:
- You will not send spam or unsolicited bulk or commercial messages, and you will comply with the CAN-SPAM Act and all other applicable laws.
- You will not use false, misleading, or forged headers, sender names, "from" addresses, or subject lines.
- You will send only to recipients from whom you have the necessary consent or a lawful basis, honor unsubscribe and opt-out requests promptly, and include required sender identification and opt-out mechanisms.
- You will not use purchased, rented, scraped, or harvested contact lists, and you will not harvest or collect others' contact information without consent.
- You will not use the Services in a manner that could cause our or our providers' IP addresses or domains to be blocklisted.
- If you use our lead-capture forms or landing pages, you will collect personal data only with appropriate notice and any required consent; you will not use them to deceptively collect data, to impersonate any person or brand, or for phishing; and you are responsible for the content of your forms and pages and for honoring the privacy choices of the people who submit information.
6. Telephone, Texting, and Call Recording
If you use the Services to send text messages, place calls, or use other messaging features:
- You will comply with all applicable laws and industry standards, including the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, Do-Not-Call requirements, and CTIA and carrier guidelines, and you will obtain all required consents.
- If any call-recording or transcription feature is offered, you will obtain all consents required by applicable law before recording, including all-party consent where required.
- You will not use the Services to make emergency calls or to provide or seek emergency services.
- You are solely responsible for any fines, penalties, or carrier charges resulting from your messaging, and we may suspend or terminate the relevant features if we or a carrier receive repeated complaints or an instruction to do so.
7. Prohibited Content and Conduct
You will not use the Services with any content, or in any manner, that:
- is threatening, abusive, harassing, stalking, defamatory, or invasive of another's privacy or publicity rights;
- is deceptive, false, misleading, or fraudulent;
- is vulgar, obscene, indecent, or otherwise unlawful;
- infringes or misappropriates any third party's intellectual-property, privacy, publicity, or contractual rights, or distributes material you do not have the rights to;
- harvests or collects information about others without their consent;
- promotes, encourages, or facilitates illegal activity; or
- promotes, encourages, or facilitates hate speech, violence, or discrimination based on race, color, national origin, religion, sex, gender identity or expression, sexual orientation, marital or parental status, age, disability, veteran or genetic status, or any other characteristic protected by law.
Organizations or individuals that promote or facilitate hate speech, violence, or unlawful discrimination are prohibited from using the Services regardless of the specific use.
8. Security and Non-Disruption
You will not, and will not permit any user or third party to:
- willfully tamper with, or attempt to gain unauthorized access to, the Services, other customers' accounts or data, or any related systems or networks;
- access, use, or reference data on the Services that is not intended for you, or log into an account or server you are not authorized to access;
- probe, scan, or test the vulnerability of the Services, or breach or circumvent security or authentication measures, except as expressly authorized under our Vulnerability Reporting Policy;
- share, reuse, sell, or transfer login credentials or API keys, or allow more than one individual to use a single login;
- introduce viruses, worms, malware, or other malicious code, or launch denial-of-service, mail-bombing, spoofing, or similar attacks;
- use bots, scrapers, spiders, or other automated means to access or extract data, except through our documented APIs and within any applicable rate limits;
- access the Services other than through our provided interfaces and APIs; or
- damage, disable, overburden, or impair the Services or interfere with any other party's use of them.
9. AI Features
Your use of the Services' AI features is governed by our AI Disclosures & Additional Terms. Without limiting those terms, you will not use the AI features to generate unlawful, deceptive, harassing, or infringing content; to develop or train competing AI models; to misrepresent AI-generated output as solely human-generated where disclosure is required by law; or to submit prohibited or sensitive data as described in Section 10.
10. Prohibited and Sensitive Data
The Services are designed to process your business's own financial and operational data. Unless we expressly agree otherwise in writing, you will not submit to the Services: Protected Health Information governed by HIPAA (we do not offer a Business Associate Agreement); full payment-card / cardholder data (other than as processed by our payment processor for billing); or other specially regulated categories of sensitive information outside of features designed for them. You will also ensure you have the rights and consents necessary to submit any personal data about others, as described in our Terms of Service and Privacy Policy.
11. Proper Use of the Services
You will use the Services for your own internal business purposes and will not:
- reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, or underlying components of the Services;
- lease, sublicense, sell, resell, rent, distribute, or otherwise commercially exploit the Services, or make them available to a third party, except as expressly permitted by your subscription;
- use the Services for timesharing, service-bureau, or similar purposes for the benefit of a third party (other than a firm-managed account expressly permitted under the Terms of Service);
- use the Services to build or benchmark a competing product or service; or
- provide any evaluation or trial version of the Services to a third party without our prior written consent.
12. High-Risk and Restricted Uses
Certain uses carry a high risk of abuse, illegality, or harm to the platform and other customers. We reserve the right to refuse, suspend, or discontinue the Services for any use that we determine, in our reasonable discretion, involves: unlawful or fraudulent businesses or schemes; deceptive "get-rich-quick," money-making, or lead-generation schemes; pyramid or unlawful multi-level-marketing programs; the sale or use of purchased or brokered contact lists; unlawful debt collection; or other activities likely to generate abuse complaints or legal exposure.
13. Trademarks
Unless you have our prior written permission, you may not use our name, logos, taglines, or other marks, or any identifier generated by the Services, including as a hyperlink or in a way that implies affiliation, employment, or endorsement, and you may not remove or alter any proprietary notices we provide.
14. Export Controls and Sanctions
You will comply with all applicable export-control and sanctions laws, and you will not use or permit access to the Services from an embargoed country or region, or by any person or entity on a U.S. Government restricted- or denied-party list, as further described in our Terms of Service.
15. Enforcement
We may enforce this AUP using any method we consider appropriate, including monitoring for complaints and abuse. If you violate this AUP, or fail to respond within a reasonable time after we contact you about a suspected violation, we may — consistent with our Terms of Service — suspend or terminate your access, remove or disable offending content, and cooperate with law enforcement. We may act immediately where we believe a violation creates a risk of harm, legal exposure, or disruption to the Services or other customers. Our decision not to enforce a provision in a particular instance is not a waiver of our right to enforce it later.
16. Changes to This AUP
We may update this AUP from time to time. When we do, we will post the updated version with a new "Last Updated" date and, where appropriate, provide additional notice. Your continued use of the Services after the update takes effect constitutes acceptance. We encourage you to review this AUP periodically.
